Mrs Normington had worked as a kitchen assistant in her local secondary school for nearly 5 years. She had complained about the new oven from the date it was installed, for about 8 weeks, as the door hinge appeared to be fitted incorrectly and the door would occasionally bounce back up as the hot tray would be being taken out of the oven.
She had taken her concerns about the safety aspect of this to the kitchen supervisor, but nothing had been done about it. Our client had a near miss; the door shut on a hot tray. Thankfully her arm was out of the way of the door or she could have been very badly burned. Mrs Normington was so scared of using the oven that she said she would not use the oven whilst it was faulty. Her supervisor advised her that if she did not work with all the equipment she should not come into work.
